This Privacy Policy explains how VOD Chatter LLC (“VOD Chatter,” “we,” “us,” or “our”) collects, uses, shares, and protects information in connection with the VOD Chatter website and services (the “Platform”). By using the Platform, you agree to the practices described in this Policy and our Terms of Service.

The Platform is intended for individuals who are at least 18 years old and located in the United States. We do not market, offer, or provide the Platform to individuals in the European Union, United Kingdom, or other jurisdictions with comprehensive data protection laws, and we do not intend to extend rights such as data access, correction, deletion, or portability except as expressly described in this Privacy Policy.

1. Information We Collect

We collect information that you provide directly, information automatically collected through your use of the Platform, information we receive from third parties such as Stripe, and information we derive through analytics and aggregated data processing.

The categories of information we collect include, but are not limited to:

• Account Information: email address, password hash (bcrypt), randomly generated username, optional custom username, scheduling preferences, notification settings, and other profile or account configuration information you choose to provide.
• Subscription & Payment Information: Stripe customer ID, subscription IDs, invoices, payment events, gift subscription relationships, payout and transaction metadata. Payment card details are handled solely by Stripe; VOD Chatter does not store full payment card numbers.
• Creator Payout Information: information required by Stripe Connect (or a similar provider), which may include legal name, address, bank details, government-required verification data, and tax information. Stripe, not VOD Chatter, stores sensitive financial details. We may receive information such as payout status, verification status, and risk/chargeback indicators.
• Technical Information: IP address, device type, browser type, operating system, access times, pages viewed, referrer URLs, and interactions with Platform features, including logs generated by our infrastructure and security systems.
• Usage & Analytics Data: interactions with channels, subscription activity, viewer counts, watch history metrics, and aggregated or de-identified analytics from providers such as Cloudflare and Google Analytics.
• LocalStorage / Cookies & Similar Technologies: essential data such as authentication tokens, viewer IDs, saved channel preferences, reduced-motion or accessibility preferences, and analytics cookies or similar technologies used by Cloudflare, Google Analytics, and other service providers.
• Additional Categories: any other information you voluntarily provide (for example, feedback, support requests, or channel descriptions) or that we describe at the time of collection.

2. How We Use Information

We use the information we collect for purposes including:

• operating, maintaining, and securing the Platform;
• creating and managing accounts, authenticating users, and providing support;
• processing payments, subscriptions, gift subscriptions, and Creator payouts;
• detecting, investigating, and mitigating fraud, abuse, and security incidents;
• enforcing our Terms of Service and other policies;
• analyzing usage, performance, and trends to improve the Platform and develop new features;
• customizing certain features and experiences on the Platform; and
• complying with legal, tax, accounting, and regulatory requirements.

Any analytics, metrics, viewer counts, subscription counts, or estimated earnings displayed on the Platform may be approximate, delayed, incomplete, or inaccurate. They are provided for informational purposes only and should not be relied upon as the sole basis for financial, legal, or business decisions.

Aggregated and De-Identified Information

We may create aggregated, anonymized, or de-identified information derived from your data, which cannot reasonably be used to identify you. Information that has been aggregated or de-identified is not considered personal information under this Privacy Policy, and we may use or disclose such information for any lawful business purpose without further notice or obligation to you.

3. Cookies, Local Storage & Third-Party Embeds

We and our service providers use cookies, local storage, and similar technologies to operate the Platform, maintain sessions, remember your preferences (such as accessibility settings), and perform analytics and security functions.

Embedded content from third-party platforms such as YouTube and Twitch is subject to those platforms’ own terms and privacy policies. These third parties may set their own cookies or tracking technologies when their embeds load on the Platform. VOD Chatter does not control and is not responsible for third-party tracking related to such embeds. You can review your browser settings or those platforms’ policies to learn more about their practices.

4. How We Share Information

We share information with third parties where reasonably necessary to operate the Platform, including:

• Payment Processors: such as Stripe, for payments, identity verification, fraud prevention, dispute and chargeback handling, and Creator payouts.
• Infrastructure & Security Providers: such as Cloudflare and other hosting, CDN, networking, and security providers, including D1 databases, Workers, logging, and email routing.
• Email & Communication Providers: such as Google Workspace or other providers used to send transactional and support communications.
• Analytics & Monitoring Providers: such as Google Analytics and Cloudflare Web Analytics, for measuring usage and performance.
• Service Providers & Contractors: other vendors who support our operations, development, security, customer support, or business processes.
• Legal & Compliance Recipients: law enforcement, regulators, courts, and others where we believe disclosure is reasonably necessary to comply with law, legal process, or governmental requests; enforce our Terms; protect the rights, property, or safety of VOD Chatter, users, or others; or detect and address fraud or security issues.

VOD Chatter does not sell or share personal information as those terms are defined under applicable U.S. state privacy laws. If we choose to engage in selling or sharing personal information in the future, we will update this Privacy Policy and provide any notices required by law before doing so.

We may also share aggregated, anonymized, or de-identified information that does not reasonably identify you with third parties for analytics, performance tracking, or other lawful business purposes.

5. International Use, U.S. Processing & Eligibility

The Platform is intended for users located in the United States. By using the Platform, you understand and agree that your information may be transferred to, stored in, and processed in the United States, where data protection and privacy laws may differ from those of your jurisdiction.

We do not market, offer, or provide the Platform to users located in the European Union, United Kingdom, or other jurisdictions outside the United States that require different privacy rights or disclosures. We do not intend to offer rights such as data access, correction, deletion, or portability except as expressly described in this Privacy Policy.

Because the Platform is intended for users 18 years or older, we do not knowingly collect information from individuals under 18. If we become aware that we have collected information from someone under 18, we may delete or disable the associated account.

6. Your Choices & Account Deletion

You can manage certain account settings directly within the Platform, including updating your email address, preferences, and notification settings, where such options are available.

You can delete your account at any time using the self-service tools provided after you log in (for example, via the account settings page). For security and verification reasons, account deletion requests submitted by email or through other channels may not be accepted or processed. The Platform may include an account recovery flow to help you regain access if needed, but we do not guarantee that recovery will always be possible.

You may contact support@vodchatter.com with general questions. For data-related requests, we may require that you use the in-product tools so we can verify your identity. We may deny or limit requests where permitted by law, including where we cannot reasonably verify your identity, where the request is excessive or abusive, or where fulfilling the request would interfere with our legal, security, or operational needs.

7. Data Retention

We retain information for as long as reasonably necessary to operate, maintain, and secure the Platform; comply with legal, tax, and accounting obligations; resolve disputes; enforce our agreements; analyze performance; and develop new features. Retention periods may vary depending on the nature of the information and our operational needs.

Deleting or closing your account does not require VOD Chatter to delete or erase information we are permitted or required to retain for lawful business, operational, security, fraud prevention, accounting, or legal compliance purposes. For example, we may retain logs, transaction records, fraud and abuse data, and other operational data as permitted by law. We may also retain aggregated, anonymized, or de-identified information indefinitely.

8. Security & No Duty to Monitor

We take security seriously and implement reasonable technical and organizational measures designed to protect information, including using reputable infrastructure and security providers, limiting access to production systems, and reviewing code and infrastructure for security issues.

However, no system is perfectly secure. To the maximum extent permitted by law, we do not guarantee that unauthorized third parties will never defeat our security measures or those of our providers, or use your information for improper purposes. To the extent permitted by law, VOD Chatter is not liable for unauthorized access to or use of your information except where directly caused by our gross negligence or willful misconduct.

We may, in our discretion, use information to detect, investigate, or respond to fraud, security incidents, abuse, or other harmful activity. Nothing in this Privacy Policy obligates VOD Chatter to actively monitor for fraud, abuse, or security issues, or to take any particular action in response to information we receive. Any monitoring or enforcement we undertake is performed at our discretion for lawful business, operational, or compliance reasons.

9. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will update the “Last Updated” date at the top of this page and post the revised version here. Changes take effect when posted unless a later effective date is specified.

To the maximum extent permitted by law, any changes to this Privacy Policy will apply to all information we hold, including information previously collected, unless otherwise required by law. Your continued use of the Platform after changes become effective constitutes your acceptance of the updated Policy. If you do not agree with the updated Policy, you must stop using the Platform.

10. Additional Terms & Reservation of Rights

This Privacy Policy works together with our Terms of Service. If there is a conflict between this Privacy Policy and the Terms of Service, the Terms of Service will control to the extent of the conflict, unless otherwise required by law.

Except as expressly stated in this Privacy Policy, VOD Chatter reserves all rights to collect, use, retain, and disclose information as permitted by applicable U.S. law. No rights are granted to you except as expressly set forth in this Privacy Policy.
